Complying With Nevada Law

In Nevada, privacy laws governing pre-employment background checks are especially strict, and employers must comply with NRS Chapter 613 and other applicable statutes. Under NRS 613.570, the use of credit reports in hiring is limited to positions involving the handling of money, access to confidential information, or where such checks are expressly required by law. NRS 179.245 prohibits employers from requesting or using sealed or expunged criminal records when making employment decisions.

Additionally, NRS 613.135 protects applicants’ digital privacy by forbidding employers from requesting access to personal social media accounts or login credentials. For public employers, NRS 613.330 through 613.335 require that criminal history inquiries be delayed until later in the hiring process, and all employers must ensure that any criminal conviction considered is directly relevant to the position’s responsibilities.

In highly regulated industries, such as childcare, healthcare, education, and gaming, more stringent background check requirements may apply.
